Our Role As A Transportation Broker
American Auto Express arranges or offers to arrange vehicle transportation between customers and independent motor carriers. AAE acts as a transportation broker and logistics coordinator, not as the motor carrier physically transporting the vehicle.
Motor carriers are independent businesses and are not employees of American Auto Express. The carrier selected for a shipment is responsible for the physical transportation of the vehicle, operation of its equipment, its drivers, route decisions, cargo handling and compliance with laws applicable to its motor-carrier operations.
AAE may assist with locating, communicating with and coordinating an appropriate carrier, but no particular carrier is guaranteed until a carrier has accepted the shipment and the assignment has been confirmed.
Instant Quotes, Estimates & Pricing
Our website may provide an automated or instant estimated transportation price based on information submitted by the customer. Pricing variables may include pickup and delivery locations or ZIP codes, approximate route distance, vehicle type and size, operating condition, open or enclosed transportation, timing and other shipment characteristics.
An instant website quote is an estimate unless and until AAE confirms the transportation arrangement and applicable price for booking. Live carrier availability and market conditions can affect the final transportation price.
Quotes may change if information supplied by the customer is incomplete or inaccurate, including but not limited to the vehicle’s dimensions, modifications, operability, pickup or delivery location, accessibility, requested dates or transport method.
Oversized, lifted, lowered, modified, non-running, specialty, exotic or otherwise non-standard vehicles may require additional equipment, space or handling and may result in a different price.
Website calculators and automated pricing tools are provided for convenience and are not a guarantee that a carrier will accept a shipment at the displayed amount.
Booking & Carrier Assignment
Submitting a quote request does not by itself constitute a confirmed carrier assignment or guarantee a pickup date. A shipment becomes subject to the applicable booking arrangement after the customer accepts the transportation terms and AAE confirms the shipment for dispatch or carrier assignment.
AAE may communicate shipment information to prospective motor carriers for the purpose of locating transportation capacity. Carrier selection may consider authority status, insurance information, availability, equipment, service area, experience, price and other business considerations.
AAE reserves the right to decline or discontinue coordination of a shipment when transportation cannot reasonably be arranged, information appears inaccurate or fraudulent, a vehicle or location presents unusual transportation requirements, or continued service would violate applicable law.
Customer Responsibilities
The customer agrees to provide accurate and complete shipment information, including:
- Pickup and delivery locations and working contact information.
- Correct vehicle year, make, model and vehicle type or size.
- Whether the vehicle is running and capable of being safely loaded and unloaded.
- Any modifications, oversized tires, lift kits, lowered suspension, racks, spoilers or other features that may affect transport.
- Any access restrictions affecting a large commercial transport vehicle.
- Any known condition that could create a safety or loading issue.
The customer represents that they are the vehicle owner or have lawful authority to arrange transportation of the vehicle. The customer is responsible for ensuring that a person authorized to release or receive the vehicle is available at pickup and delivery.
Pickup, Delivery & Scheduling
Pickup and delivery dates and times are estimates unless specifically confirmed otherwise. Vehicle transportation is affected by traffic, weather, mechanical conditions, road closures, carrier scheduling, federal hours-of-service requirements, customer availability and other circumstances.
Door-to-door transportation means pickup and delivery as close to the requested addresses as the carrier can safely and legally access. A carrier may request an alternate nearby meeting location when streets, low-clearance areas, weight restrictions, gated communities, narrow roads or other conditions prevent safe access by the transport vehicle.
The customer must provide accurate pickup and delivery contacts and make reasonable arrangements to meet the carrier when requested.
Vehicle Condition, Inspection & Bill Of Lading
The customer should inspect the vehicle with the motor carrier at pickup and delivery. The carrier may prepare a Bill of Lading (“BOL”), vehicle condition report, photographs or other transportation documentation.
The customer or authorized representative should review the condition report carefully before signing. At delivery, the vehicle should be inspected before the delivery documentation is signed whenever reasonably possible.
Any new or alleged transportation damage should be noted on the carrier’s delivery documentation before the carrier leaves when reasonably possible. Photographs and other supporting evidence should be preserved.
Personal Property & Items Inside Vehicles
AAE arranges transportation of vehicles, not household goods or personal-property shipments. Customers should remove valuables, important documents, medications, firearms, hazardous materials, prohibited items and unnecessary personal belongings before pickup.
Any items permitted by a motor carrier are subject to that carrier’s policies, applicable law and weight or safety restrictions. AAE does not accept custody of personal items placed inside a vehicle and does not guarantee protection against loss, theft or damage to such items.
Payment & Charges
The customer agrees to pay all amounts accepted or otherwise agreed upon for the transportation arrangement. Payment structure, timing and method may vary by shipment and may include amounts payable to AAE and/or amounts payable in connection with the motor carrier’s transportation services.
Any applicable deposit, brokerage fee, carrier payment, cancellation charge or other payment obligation will be disclosed as part of the applicable booking or transportation arrangement.
Customers are responsible for ensuring that payment information provided is accurate and that they are authorized to use the selected payment method. Chargebacks or payment disputes do not eliminate amounts legitimately owed under an accepted transportation arrangement.
Cancellations & Changes
Cancellation and refund eligibility may depend on whether a carrier has already been assigned, dispatched or incurred costs in reliance on the booking. Shipment-specific cancellation terms communicated during booking will control when they differ from general website information.
Customers should notify AAE promptly of cancellations or changes to locations, dates, vehicle condition, vehicle type or transportation method. Material changes may require a revised quote.
If AAE cannot arrange transportation and no carrier has been assigned, any applicable payment or refund will be handled according to the booking terms and the nature of the payment collected.
Delays & Events Outside Our Control
AAE does not guarantee exact pickup or delivery times and is not responsible for delays caused by events outside AAE’s reasonable control, including severe weather, natural disasters, traffic, road closures, accidents, mechanical failures, government action, labor disruptions, carrier scheduling changes, acts of God or other transportation interruptions.
Customers should not schedule flights, moving deadlines, vehicle sales, repairs or other time-sensitive commitments based solely on estimated pickup or delivery dates.
Vehicle Damage & Claims
The independent motor carrier performing transportation is responsible for the physical custody and transportation of the vehicle while it is in the carrier’s possession, subject to applicable law, the carrier’s transportation documents and insurance coverage.
If damage is alleged, the customer should document the condition immediately, note the damage on the carrier’s Bill of Lading or delivery documentation when possible, take photographs and promptly notify both the carrier and AAE.
AAE may assist the customer with obtaining carrier contact or insurance information and facilitating communication, but AAE does not make the carrier’s insurance coverage determination and does not itself adjust or pay a motor-carrier cargo claim unless separately required by law or expressly agreed in writing.
Quote Numbers & Shipment Tracking
AAE may assign a quote number that also functions as a shipment tracking number. Customers may be able to access shipment information using that number or the phone number associated with the shipment.
Tracking information is provided as a convenience and may reflect updates entered by AAE based on information received from customers, carriers or other service providers. Tracking information may not be continuous, real-time GPS data and should not be interpreted as a guarantee of a vehicle’s exact physical location.
Customers should protect their quote/tracking number and use reasonable care when entering personal information into the tracking system.
Email, Phone & Electronic Communications
By submitting contact information in connection with a quote or shipment, you authorize AAE to contact you regarding that quote, shipment, booking, carrier assignment, pickup, delivery, payment, customer service or other transaction-related matters using the contact information you provide.
Transactional communications may include email, telephone calls and text messages when appropriate. Marketing communications, if used, will be handled in accordance with applicable law and any consent requirements that apply.
You are responsible for providing accurate contact information and for notifying AAE if your information changes.
Website & Technology Use
The AAE website, instant quote tools, shipment tracking tools, text, graphics, logos, design elements and related technology are provided for lawful use in connection with vehicle transportation services.
You agree not to:
- Use the website for fraudulent, unlawful or abusive purposes.
- Submit false customer, vehicle, payment or shipment information.
- Attempt to interfere with, reverse engineer, bypass or compromise website security or functionality.
- Use automated systems to scrape, overload or misuse the website without authorization.
- Impersonate another person or use another person’s tracking information without authorization.
We may modify, suspend or discontinue website functionality when reasonably necessary for maintenance, security, legal compliance or business operations.
Disclaimers & Limitation Of Liability
To the fullest extent permitted by applicable law, AAE makes no warranty that website access, automated pricing, carrier availability, tracking information or transportation timing will be uninterrupted, error-free or available at all times.
AAE is not the motor carrier and does not control the carrier’s drivers, equipment, physical handling of the vehicle, routes or day-to-day transportation operations.
To the fullest extent permitted by law, AAE will not be liable for indirect, incidental, special, exemplary, punitive or consequential damages, including lost profits, lost use, missed appointments, lodging, rental-car expense or other consequential losses arising from a transportation delay, carrier conduct or use of the website.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.
Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless American Auto Express Logistics LLC and its members, employees, representatives and agents from claims, losses or expenses arising from your material breach of these Terms, your unlawful use of the website, your lack of authority to ship a vehicle, or materially false or misleading information you provide.
This provision does not require you to indemnify AAE for liability that applicable law prohibits AAE from shifting to you.
Governing Law & Severability
These Terms are governed by applicable federal law and, to the extent state law applies and is not preempted, the laws of the State of Texas, without regard to conflict-of-law principles.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
Changes To These Terms
AAE may update these Terms as our website, services, technology or legal obligations change. The effective date displayed at the top of this page identifies the current version.
Changes apply prospectively unless applicable law requires otherwise. Your continued use of the website after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by law.
